COPPA Compliance and Children’s Privacy

Factile is designed for educational use by teachers, schools, and school districts. Students do not need to create personal accounts to participate in teacher-hosted games. However, if a child under 13 wishes to create an individual account, we collect a parent’s email address for that purpose.

Information Collected From Students

Factile does not require children to provide personal information, such as full names, email addresses, phone numbers, or physical addresses, to participate in teacher-hosted games.

If a child under 13 registers for an individual account, we collect only a username and a parent’s email address for consent purposes.

When students participate in Factile games, limited information may be collected solely to support educational gameplay, including:

  • A display name, nickname, or team name selected by the teacher or student
  • Game responses, scores, and participation data

This information is used only within the context of the educational activity.

Use of Student Information

Student information is used exclusively for educational purposes, including:

  • Operating live and self-paced games
  • Displaying scores and progress during gameplay
  • Allowing teachers to review results and learning outcomes

Factile does not use student information for advertising, marketing, or behavioral profiling, and student data is never sold.

School Consent and Parental Rights

When Factile is used in a classroom or school-directed setting, Factile relies on schools and educators to obtain parental consent, as permitted under COPPA’s school consent exception.

By using Factile with students under the age of 13, schools and educators represent that they have obtained any required parental consent for student participation in educational activities using the platform.

Parent Access, Review, and Deletion Requests

Parents and legal guardians have the right to:

  • Request access to their child’s information
  • Request correction or deletion of their child’s information
  • Withdraw consent for continued data collection

Requests may be submitted through the school or district, or directly to Factile by emailing [email protected].

Factile may require verification before fulfilling a request and will respond within a reasonable timeframe.

Data Retention and Security for Student Data

Factile retains only the data necessary for educational gameplay, such as:

  • Leaderboard scores
  • Team names
  • Nicknames (only if provided by the teacher or student)

This data is retained for as long as required to support gameplay and educational activities. We do not take or retain sensitive personal information like full names, contact details, or other identifying data.

Factile implements reasonable security measures to protect the data that we store, including:

  • Encryption for data
  • Restricted access controls for internal staff and systems
  • Secure infrastructure to protect against unauthorized access and breaches

We do not store any personal data beyond what is necessary to provide the services and support educational activities.

Under 13 Account Registration

If a user indicates that they are under 13 during registration, Factile:

  • Requires a username (not a real name)
  • Requires a parent or legal guardian’s email address
  • Collects a password for account access

The parent’s email address is used solely to:

  • Obtain parental consent (where required)
  • Provide account-related communication
  • Facilitate access, review, or deletion requests

We do not use parent email addresses for marketing or advertising purposes.
